Estate and probate steps

When someone passes away owning a home, the home usually can't be sold until the estate is dealt with. In Alberta this often means applying for a grant of probate through the surrogate matters of the Court of King's Bench of Alberta. Probate is the court confirming that the will is valid and that the personal representative (often called the executor) has authority to act. If there is no will, someone applies to become the administrator instead. Whether probate is needed depends on how the home was owned and other facts. This is general information, not legal advice. Tax on an inherited home

An inherited home can have tax effects. In Canada an estate may face a deemed disposition, and capital gains tax can apply depending on whether the home was the deceased's principal residence and what happens between the date of death and the sale. The rules are detailed and depend on your situation. I am a REALTOR®, not a tax advisor, so I will not give you tax figures. My fee is always negotiable. There is no standard rate in Alberta. We agree on the fee and put it in a written agreement before your home goes on the market. If a rebate applies to your situation, I put that in writing too.

Questions, answered

Do I have to sell right away?
No. There is no rush. Many inherited homes sit while the family sorts out the estate. We move when you are ready, not before.
What does it cost to work with you?
My fee is always negotiable. There is no standard rate in Alberta. We agree on it and sign a written agreement before we list the home. The first talk is free.
Can you help with probate or the will?
I am a REALTOR®, not a lawyer. I cannot give legal advice. I can point you to an estate lawyer who handles probate, and I can work with them on the sale.
Will I owe tax when I sell?
I am not a tax advisor, so I cannot tell you what you will owe. A CPA can walk you through capital gains and other tax on an inherited home. I am glad to refer one.
The home needs work. Is that a problem?
No. Many inherited homes need cleaning or small fixes. Some are fine as they are. I give you honest advice, and you choose what to do.
